Terms and Conditions
Welcome to our freelance marketplace. These Terms and Conditions (“Terms”) govern your access to and use of our website and services.
Acceptance of Terms
By accessing, registering, or using our marketplace in any manner whether as a freelancer or a client you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you must not use the site.
2. Nature of Our Platform
We provide a digital marketplace that connects freelancers with clients who need professional services. We are not an employer or agent of any freelancer. All contracts, work arrangements, payments, and outcomes are solely between the freelancer and the client. Our platform acts as a facilitator, not a service provider.
3. Account Creation and Responsibilities
To use our platform, you must create an account as either a freelancer or a client. You agree to provide accurate, complete information during registration and to keep your account details secure.
You are responsible for:
Maintaining confidentiality of your login credentials
All activities that occur under your account
Updating your information if it changes
Not impersonating others or creating fake accounts
We reserve the right to suspend or terminate any account we find in violation of these rules.
4. Payments and Platform Fees
All payments between clients and freelancers must be made through the platform. Clients are required to fund projects in advance using our secure payment gateway. Funds are held in escrow until the client approves the submitted work.
For Freelancers: A service fee (10%) will be deducted from your earnings before withdrawal.
For Clients: You will be charged the agreed project amount plus any applicable transaction fees.
We may update our fee structure at any time with prior notice.
5. Escrow System and Payment Release
Our escrow system protects both parties. Here’s how it works:
Clients deposit funds for a project
Freelancers complete and submit the work
Clients approve the work
Funds are then released to the freelancer
If a dispute arises, our dispute resolution process (see below) will determine the outcome.
6. Dispute Resolution
In the event of a disagreement between a freelancer and a client:
Both parties should first attempt to resolve the issue through communication.
If unresolved, either party may open a dispute.
Our support team will review evidence such as chat history, submitted files, and payment logs.
A fair and binding decision will be made by our platform, and funds may be released or refunded accordingly.
Please note that decisions made through this process are final.
7. Refund Policy
Refunds may be granted if:
A freelancer fails to deliver the agreed-upon service
There is a confirmed violation of our platform rules
A client cancels a job before the freelancer has started working
All refund requests are subject to case-by-case review.
8. Prohibited Activities
The following actions are strictly prohibited:
Requesting or making payments outside the platform
Posting false information or fake profiles
Uploading harmful files or malicious content
Harassment, abuse, or discrimination
Copying content or code from the platform
Misrepresentation of skills or credentials
Any violation can lead to immediate account suspension or legal action.
9. Intellectual Property Rights
Unless otherwise agreed:
Freelancers retain ownership of their work until full payment is made
Upon payment, ownership of the work is transferred to the client
All content created on the platform must respect copyright laws
Clients do not gain rights to use or modify any work until payment is completed.
10. Platform Changes and Availability
We may update or improve features of the platform at any time, including adding, removing, or changing functionalities. We are not liable for any downtime, technical issues, or data loss caused by updates or server interruptions.
11. Termination and Suspension
We reserve the right to suspend or permanently terminate any account that:
Violates our Terms or policies
Harms other users
Engages in fraudulent behavior
Attempts to bypass platform systems
Termination may occur without prior notice depending on the severity of the violation.
12. Limitation of Liability
We are not liable for:
Work not delivered or delivered late by freelancers
Dissatisfaction with the quality of service
Any direct or indirect losses resulting from user behavior
Communication outside the platform leading to fraud or scams
Users are responsible for conducting their own due diligence before working together.
13. Privacy and Data Protection
Your privacy is important to us. Please refer to our [Privacy Policy] for details on how we collect, use, and protect your personal data.
14. Updates to Terms
We may update or improve features of the platform at any time, including adding, removing, or changing functionalities. We are not liable for any downtime, technical issues, or data loss caused by updates or server interruptions.
